Terms and Conditions

Applies to Ponce AI Products: Treatment Finder, Facial Analysis, and Treatment Planner

Welcome to Ponce AI ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of Ponce AI applications, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

1. Service Overview

Poncé Facial Analysis provides an educational platform that allows users to upload photos and videos of their face for personalized aesthetic suggestions, including recommendations for treatments such as oral/topical solutions, fillers, and neurotoxins. The app is designed to help users navigate the medical aesthetics space, but we do not directly provide medical treatments. We connect users with third-party providers for treatment planning.

2. User Accounts

  • Account Registration: To use certain features of the Service, you will be required to create an account and complete an onboarding form. You must provide accurate, complete, and current information, including your name, email address, phone number, and facial photos.

  • Account Security: You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account.

3. Eligibility

  • Age Requirement: The Service is intended for users who are at least 18 years old. By using the Service, you represent and warrant that you are 18 years of age or older. If you are under 18, you are not permitted to use the Service.

  • User's Responsibility: By agreeing to these Terms, you confirm that you meet the age requirement. If we discover that you are under 18, we reserve the right to terminate your access to the Service.

4. Collection and Use of Personal Information

By using the Service, you acknowledge that we may collect, use, and disclose information as described in our Privacy Policy.

This may include photos, videos, contact information, technical information, and other information necessary to provide the Service and its features.

We may also use information that has been de-identified and/or aggregated in accordance with our Privacy Policy for analytics, product development, service improvement, and related lawful business purposes.

  • Upload any content that is unlawful, harmful, or invasive of another's privacy.

  • Use the Service for any purpose that is illegal or in violation of these Terms.

  • Reverse engineer, decompile, or disassemble the Service.

The Service may interact with third-party services. We do not control these third-party services, and you agree that we are not responsible for the content, policies, or practices of these third-party platforms.

7. No Medical Advice

The content provided on the Poncé Facial Analysis platform is for educational purposes only and is not intended as a substitute for professional medical advice. Any treatment suggestions made through the Service are for informational purposes, and you should consult with a qualified healthcare provider before proceeding with any medical treatments.

8. Data Use and De-identified Information

As between the parties, personal information and user-submitted content remain subject to the rights and permissions described in the Privacy Policy. We may generate and use de-identified and aggregated information derived from use of the Service for lawful business purposes, including improving and developing the Service, provided that such information does not reasonably identify an individual.

9. Limitation of Liability

To the maximum extent permitted by law, Ponce AI and its affiliates shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, arising out of your use or inability to use the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. By using the Service, you agree that any legal disputes will be resolved in California.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of the Service after any changes to the Terms will constitute your acceptance of such changes.

We may terminate or suspend your access to the Service at any time, with or without cause, and without prior notice or liability.
